This is an agreement between you, and all relevant persons that you purport to represent, and Kanopi ICT regarding your access to and use of the Kanopi ICT website and all content, information, products and services available on or through the Website. For the purpose of this agreement, “person” includes a natural person and any type of incorporated or unincorporated entity.

Each time you use the Website you signify your acceptance and agreement, and the acceptance and agreement of any person that you purport to represent, to be bound by this agreement as it then reads. You represent and warrant that you have the legal authority to accept this agreement on behalf of yourself and any person you purport to represent.

This website is for convenience and informational purposes only and is not intended to convey advice or a recommendation of any product or service.

Subject to any licence agreement between you and Kanopi ICT, and without Kanopi ICT prior express written consent:

You agree that such third parties are responsible for the operation and contents of their websites, and that Kanopi ICT has no liability to you or to any other person for the use of those websites.

All information that you provide through the Website, including registration information (name and email address), payment information (credit card numbers and expiry dates) and transaction related information, must be true, accurate, current and complete. Kanopi ICT will rely on the information that you provide. By providing such information and data about yourself (“Personal Data”), you consent to the processing of your Personal Data as set out in the Kanopi ICT Privacy Policy. You will be solely responsible and liable for any loss, damage and additional cost that you, Kanopi ICT or any other person may incur as a result of your submission of false, incorrect or incomplete information.

Kanopi ICT expressly reserves all rights in connection with its intellectual property, including without limitation the right to block the transfer of its products and services and to track usage thereof through electronic tracking technology and all other lawful means, now known or hereafter devised.
5. Kanopi ICT reserves the right, without further notice, to pursue to the fullest extent allowed by law any and all criminal and civil remedies for violations of its rights.
6. Linking to the Website without the written permission of Kanopi ICT is strictly prohibited. To request permission to link to the Website, please make a formal request to the Kanopi ICT marketing department. Kanopi ICT may at its discretion cancel and revoke any permission it gives to link to the Website at any time without notice or liability.
7. The framing, mirroring, scraping or data mining of the Website or any of its contents in any form and by any means is strictly prohibited. You may not use any collaborative browsing or display technologies in connection with your use of the Website.

In no event shall Kanopi ICT, its affiliates, employees, agents or representatives be liable for any indirect, consequential, special, incidental or punitive damages, including without limitation errors or omissions in the information in connection with the Website.

You agree to indemnify, defend and hold harmless Kanopi ICT, its officers, directors, employees, affiliates and representatives from and against any and all liabilities, expenses and costs, including without limitation reasonable legal fees and expenses incurred by Kanopi ICT, in connection with any claim or demand arising out of the Website and your breach of this agreement. You will assist and cooperate as fully as reasonably required by Kanopi ICT in the defence of any such claim or demand.

Kanopi ICT may at its sole and absolute discretion change this agreement from time to time as it relates to future use of the Website, by posting a revised agreement on the Website. By using the Website after a revised agreement has been posted, you signify your acceptance and agreement to be bound by the revised agreement. You may not change this agreement in any manner.

Notwithstanding any other provision of this agreement, Kanopi ICT may at its discretion change, discontinue, modify, restrict, suspend or terminate the Website or any part of it without notice or liability to you or any other person. Kanopi ICT may at its discretion and for its convenience at any time immediately terminate, temporarily or permanently, this agreement or your permission to access and use the Website without notice or liability to you or any other person.
